WEB SHOP GENERAL TERMS & CONDITIONS

1. General

These Terms and Conditions apply to the use of Linde’s Web Shop and accompany and supplement Linde Gas and Other Items Sales General Terms and Conditions and Linde Rental General Terms and Conditions available here unless Linde and the Customer have agreed otherwise beforehand. Section 7 of these Terms and Conditions applies only to transactions made between Linde and Consumers. Please review these documents carefully before using our Web Shop as these constitute a binding agreement between Linde and you. Linde reserves the right to change these Terms and Conditions. The amendments shall enter into force upon publication on this page.

2. Definitions

“Customer” shall mean a natural person or a legal entity.
“Consumer” shall mean a natural person acting wholly or mainly outside the course of trade, business or profession.
„Linde“ shall mean AS Linde Gas (registry code 10098649, address Valukoja tn 8-Öpiku maja, 11415 Tallinn) operating the Web Shop and delivering Products to the Customer.
“Web Shop” online services provided by Linde for the purchase of Products.
“Products” are products or items that the Customer orders via the Web Shop.

3. Product Information and Price

The Product Information and Prices are provided to the Customer in the Product listings in the Web Shop. Other Prices may apply, if a particular Customer and Linde have agreed so beforehand. Linde reserves the right to amend Product Information and Prices without prior notice. The prices of the Products composing confirmed orders are not subject to changes. The Product images on the website are for illustrative purposes and do not constitute the exact appearance of the Product.

4. Ordering

The Customer is required to confirm that the Products’ technical specifications meet the requirements for which they are being purchased before placing an order. Orders are confirmed and become binding from the moment the payment is received in full by Linde, unless otherwise agreed by the parties beforehand. The parties may change the confirmed order where necessary. Linde confirms that the Products conform to the statutory requirements and specifications may be found here. Linde may cancel any sales transactions, including confirmed orders, if the information on price, availability or specification provided to the Customer in the ordering process has been incorrect, payment is made late or Linde is otherwise not able to deliver the Products. Linde shall inform the Customer about cancellation and refund or agree on replacement delivery within reasonable time but not later than 14 days from placing the order.

5. Payment

Payment terms are provided to the Customer in the course of the ordering process on the Web Shop. The price information provided on the Web Shop before the Customer places the order includes information on billing terms and all fees applied by Linde, as well as interest on late payment. Linde provides the Customer with payment instructions or guidance via e-mail or Web Shop after the Customer has placed the order. Upon changing the order, Linde provides the Customer with additional payment instructions or guidance in the manner as agreed by the parties, or debits the Customer's credit card in the amount of the additional charge. Linde returns the overpaid amount to the Customer in the manner used by the Customer for payment.

6. Delivery

Delivery fee is included in the final sales price of the Products. Linde shall deliver the Products to the Customer in accordance with the delivery method chosen by the Customer in the Web Shop. Delivery terms are provided to the Customer by the Web Shop prior to placing the order. The Customer is obliged to inspect the Products upon delivery and confirm the Product’s conformity with the order. Risk and title to the Products is transferred from Linde to the Customer upon delivery provided that Linde has received payment for the Products in full. Linde retains the title to the delivered Products until the Products have been paid for in full.

7. Returns and Refunds to Consumers

The Consumer has the right to cancel the order and return the Products without giving any reason by contacting Linde’s customer service or sending the cancellation application klienditeenindus.ee@linde.com to the following e-mail [●]within 14 days of receiving the Products. The Consumer may cancel the order and return the Products only if the Products have not been used in any other way than is necessary to ensure the nature, characteristics and functioning of the Products in the same way and extent the Consumer is entitled to test similar Products in an actual store. If the Products have been used for any purpose other than is necessary to ensure the nature, characteristics and functioning of the Products, or if there are any signs of use or wear and tear, Linde may reduce the refund for the Products in accordance with the decrease in the value of the Products. Linde shall issue a refund to the Consumer within 14 days upon receipt of the cancellation application from the Consumer. Linde may refuse from the refund until the Consumer has returned the Products to Linde.

Linde has the right to refuse cancellation and returns where:

  • a) the Products’ valve seal has been broken (unsealed Products are not suitable for return due to health and safety protection requirements);
  • b) the Products have been manufactured or obtained taking into account the personal needs of the Consumer;
  • c) the Products have been manufactured or obtained according to the conditions established by the Consumer;
  • d) the Products deteriorate or expire rapidly (including but not limited to dry ice).

The Consumer shall compensate Linde for any costs for returning the Products and reasonable loss in value of the delivered Products. Customers who are not Consumers are not eligible for the cancellation right described in this Section.

8. Complaints

Should you have any questions or complaints regarding the Web Shop, please contact Linde’s customer service at [●]. In case of transactions between Linde and Consumers, if the Consumer and Linde are unable to resolve the dispute by agreement, the Consumer may refer the matter to the Consumer Protection Board at https://komisjon.ee/ or to the European Union Online Dispute Resolution Platform at https://ec.europa.eu/consumers/odr/.

9. Personal Data

Linde processes all personal data in accordance with applicable data protection legislation and Linde’s Privacy Policy available here. The Customer is required to obtain all necessary rights to share personal data of representatives, employees and other data subjects whose data is shared with Linde while using the Web Shop. The Customer must ensure that all account information on the Web Shop including any username and password is kept safe, secure and confidential. Linde uses cookies on the Web Shop in accordance with Linde’s Cookie Policy available here.
