Regulation (EC) No 1272/2008 on classification, labelling and packaging (CLP) of substances and mixtures) comes into effect on 1 st of December 2010 for substances and 1.6.2015 for mixtures. This regulation implementation means the following for our operations:
Pure gases
All pure gas (= substance, e.g. oxygen, nitrogen, argon, carbon dioxide, helium, acetylene, N2O, CO etc.) receptacles (gas cylinders, dewars etc.) leaving our production plants from 1.12.2010 onwards will have new labels. The new safety data sheets for these gases will be published on our home pages
Gas mixtures
For gas mixtures (e.g. Odorox, Mison, LPG, speciality gas mixtures) new labels and safety data sheets will be required only by 1.6.2015. Until then mixtures shall be classified, labelled and packaged in accordance with the existing legislation (Directive 1999/45/EC).
Depots
There are transitional periods for two years (i.e. up to 1.12.2012 for substances and up to 1.6 2017 for mixtures) for the cylinders that are already in circulation (placed into market). This means that cylinders already at customers, third party sales centres or gas distributors before 1.12.2010 don’t need to be relabelled before these transitional dates.
Storage vessels
The storage vessels at production sites and at customer sites don’t need to be relabelled according to CLP before the local legislation for the labelling of hazardous chemical storage vessels has been updated according to CLP.
New hazard class “gases under pressure”
One of the new issues in CLP classification is a new hazard class “gases under pressure”. This means that all gases that have > 2 bar pressure in a receptacle are considered hazardous. This hazard class is one of the consequences of the harmonization with the regulations for the transport of dangerous goods where pressure is considered as a primary hazard.
Other changes
The other biggest differences compared to the old classification are the new diamond shaped red and black pictograms instead of the old orange and black hazard symbols, new Hazard (H) and Precautionary (P) phrases instead of old R and S phrases, and the introduction of new signal words Warning and Danger.
ADR
The ADR (Agreement of Dangerous goods by Road) symbols will remain as they are today.
